GENERAL TERMS & CONDITIONS

Elegant Earth (EE) is a manufacturer selling to the trade only.  All accepted orders are subject to Elegant Earth’s Terms & Conditions.  Pricing, terms and conditions are subject to change without notice.

PRICING AND ORDERING INFORMATION

TRADE: Trade professionals, i.e. interior designers, architects, landscape designers/architects, event planners, contractors and all other non-retail design businesses must provide a copy of a valid resale certificate and business license (if applicable) prior to placing an order.

LEGACY DESIGNER: Trade professionals who place a single order of $2,500 shall enter our Legacy pricing tier of an additional 10-12%* off net trade pricing.  Requires $5,000 yearly invoiced amount (product only, excludes freight) to maintain this status.

DEALER: To qualify for dealer pricing, you must have a retail store or to the trade showroom. The retail location/showroom must have a core business of reselling furniture, garden products, home accessories or lifestyle. Valid resale certificate, business license (if applicable) and store/showroom photos are required prior to placing an order.

ORDER PLACEMENT: Orders may be placed in person at participating trade shows, online through the customer portal, in writing with an Elegant Earth sales team member, or by emailing orders@elegantearth.com. Once an order has been received it will be turned into a quote and emailed to you to verify payment method and shipping instructions (quotes are valid for 30 days). Once you have confirmed the quote, along with payment method, an order acknowledgement will be generated for your review. It is your responsibility to check accuracy of product, quantities, finishes, ship to address and any shipping instructions. The order acknowledgement must be confirmed in writing. Confirmation of shipping and payment information is required to finalize and process the order.

CUSTOM ORDERS: The Studio at Elegant Earth is available for custom residential, contract and restoration. Custom orders are accepted based on material request and project feasibility. All accepted custom orders require a 50% deposit and 50% balance due at shipping.

PAYMENT: Orders must be prepaid with company check, ACH or credit card. Visa, Mastercard, and American Express accepted.

NET 30: May be established with credit approval after prepaid initial order. Banking and trade references required. If collection is necessary, customer is liable for any and all collection costs, including attorney’s fees.

CANCELLATION/RETURNS: Notice of cancellation is required in writing within ten (10) days of the date of the order acknowledgment. Orders cancelled after this time will be subject to a 25% cancellation fee. Merchandise refused or returned without authorization will be subject to a 25% restocking fee plus all freight charges.

BACK ORDERS: Every effort is made to ship all orders complete, however at times due to manufacturing considerations, orders may ship incomplete. Back orders will be included as part of a subsequent order by request only.

PRODUCT INFORMATION

Our Cast Stone pieces and the finishes applied to them are made from natural materials and crafted by hand. Variations in color and texture should be expected as they are a part of the aesthetic of our line. Brushstrokes, drips, bugholes, crazing, efflorescence and seams are inherent to the hand cast/ hand finished process. Due to these variations and differences in lighting, finishes on our products in the catalog, on our website and in social media will often look different in person.

Additionally, our water-based finishes are made to dovetail with the natural aging process- therefore lightening and/or darkening of the finishes exposed to the elements should be expected. Staining from leaves, nuts, berries, etc. are not uncommon and usually dissipate over time and do not constitute a product flaw. Product care instructions are available online.

SHIPPING AND RECEIVING

METHOD: All orders ship FOB Birmingham, AL (unless otherwise noted). Shipments are sent on pallets via common carrier. Please be prepared to accept palletized shipments. The shipping service provided is dock to dock or curbside drop off. Common carriers do not enter location and do not assist with uncrating/unwrapping or removal of packing materials. Liftgate and call notice can be provided upon request, fees will apply.

RECEIVING: All products leave our factory after undergoing our strict quality control standards. Our pieces may have subtle imperfections which are intentional in order to give character to each piece. Due to our hand applied process variations in finishes will exist. It is the customer &/or receiver’s responsibility to inspect the shipment for damage. If any external damages are found to the packaging, it must be noted on the receiving bill of lading before the driver leaves the dock. You must notify EE of any concealed damage or shortages within 48 hours of delivery. Please note that most minor chips can easily be remedied by using the TOUCH UP KIT provided in each shipment; some repairs are expected to be made in the field.

3RD PARTY RECEIVERS:  If you are unable to receive our product directly, we will gladly ship orders to 3rd Party Receivers. We will not be responsible, however, for any 3rd party charges or fees including but not limited to handling, deliveries, and storage. Please note that once our items are removed from their original packaging, we cannot be responsible for any damages that occur thereafter.

SERVICES/FEES: Liftgate, appointments/call notices and drop shipping are subject to additional fees. Freight up-charges may apply to remote areas, limited access areas and highly congested areas. Fuel surcharges may apply to all destinations.

FREIGHT ESTIMATES: Freight estimates are based on destination and shipping requirements.

Due to ongoing fluctuations in the shipping industry, estimated rates do not always apply and can change at any time.

BULK FREIGHT DISCOUNT: Dealer orders $10,000 or above and Legacy orders $14,000 or above being delivered to a commercial address with a standard dock or forklift onsite for unloading qualify for a 10% reduction of the percentage rate in the freight chart.

FACTORY PICKUPS: Pickups are allowed at the factory with a scheduled appointment and with a proper vehicle for loading. Handling charges apply.

ANTIQUE ITEMS: Antiques and one-of-a-kind pieces must be paid for at time of purchase and are sold as is. If Elegant Earth is shipping these purchases, they must be shipped with a minimum order of our production line. Dollar amounts of antiques and one-of-a-kind pieces do not count towards the minimum order total.
